Lowey Upholds Certification of the Class In CHS Securities Class Action; Sixth Circuit Rejects Defendants’ Petition

On October 23, 2019, the Court of Appeals for the Sixth Circuit denied defendants’ application for leave to appeal certification of the class of Community Health Systems, Inc. (“CHS”) shareholders and the appointment of Lowey Dannenberg as Lead Counsel for the Class.  District Court Judge Eli Richardson had certified the Class of investors bringing fraud claims against CHS for the period April 11, 2006 through October 26, 2011.  Lowey Dannenberg was appointed Class Counsel based on the Court’s findings that Lowey Dannenberg has “extensive experience and knowledge with securities class Actions, to say the least.”  The Court also acknowledged Lowey’s “significant work in identifying and investigating the potential claims in the action, as clearly evidenced from its eight years of persistently litigating this case.”
