Case Abstract
On February 19, 2010, the Honorable Cynthia Rufe, District Court Judge for the Eastern District of Pennsylvania, granted preliminary approval of a settlement of $907,566 plus the costs of administration to resolve class members’ claims that Best Buy Co., Inc. and certain of its affiliates (“Best Buy”) violated the Pennsylvania Minimum Wage Act of 1968 and The Pennsylvania Wage Payment and Collection Law, by not paying its employees for all of the time they worked.  In addition to the monetary component of the settlement, Best Buy has agreed to modify its Standard Operating Procedure Manual in order to assure that, going forward, its employees are paid for all time that they are required to spend at a store.

Current Status
Class Action Settlement granted on February 19, 2010.  Final approval hearing is scheduled for November, 2010.

A similar action filed by Lowey Dannenberg in the United States District Court for the Eastern District of New York on behalf of present and former New York Best Buy employees has been settled for $902,410 plus other non-monetary relief and the costs of administration, and preliminarily approved.  Turner v. Best Buy Co., Inc., Case Number 08-cv-1024 (E.D.N.Y.).
