Nationwide class certified for residential borrowers against Washington Mutual
In Cassese, et al. v. Washington Mutual, Inc.., et al., Lowey Dannenberg Cohen & Hart, PC serves as co-Lead Counsel for a certified class of residential mortgagors against Washington Mutual, Inc. and the FDIC, as receiver for Washington Mutual Bank. Plaintiffs allege that certain fees, finance charges and prepayment penalties they were charged when paying off their loans were assessed in violation of their note agreements and several state laws.
On December 29, 2008, Judge Spatt of the United States District Court for the Eastern District of New York certified the action as a class action, finding that class counsel, including Lowey Dannenberg, "manifested a willingness to devote necessary resources to litigate vigorously on behalf of the entire class."
