Lowey Dannenberg Attorneys Appointed Interim Co-Lead Counsel in Nexium Consumer Fraud Litigation

 
 
Case Abstract
On September 3, 2009 Lowey Dannenberg Partners Barbara Hart and Gerald Lawrence were appointed interim co-lead counsel in the Nexium consumer fraud consolidated litigation, captioned Pennsylvania Employee Benefit Trust Fund, et al. v. Zeneca, Inc., et al., Case No. 05-cv-0075, pending in the United States District Court for the District of Delaware. Lowey Dannenberg and its Co-Counsel recently filed an amended consolidated complaint (under seal) alleging that defendants Zeneca, Inc. and AstraZeneca Pharmaceuticals, LP, fraudulently developed and marketed Nexium as superior to Prilosec, a widely used drug used to treat heartburn and esophageal erosions. Plaintiffs allege that Nexium was identical to Prilosec and was marketed solely for the purpose of shifting market share to the newer, more expensive version of essentially the same drug. This deception resulted in hefty overcharges to the consuming public and insurance companies.
