Barbara Hart to Speak at Conference on Private Antitrust Enforcement
The American Antitrust Institute is hosting its annual Private Antitrust Enforcement Conference at the National Press Club in Washington, D.C. on Wednesday, November 9.
Lowey Dannenberg Cohen & Hart CEO Barbara Hart will speak on the panel “Ethical Issues Arising in the Certification and Settlement of Class Actions: Is What’s Good for the Goose, Good for the Gander?” This panel will discuss the ethical issues that can arise from potential intra-class conflicts in the context of both the certification and settlement of class actions. The topics that will be discussed include: settlements that release future claims; the formation of subclasses or classes with separate representation for litigation or settlement purposes; the appropriate use of allocation counsel in a settlement context; and best practices for developing an allocation process that will withstand scrutiny from the court and objectors.
Co-panelists include Christopher M. Burke of Scott+Scott, LLP and Joshua P. Davis of the University of San Francisco School of Law. The panel is moderated by Ellen Meriwether of Cafferty Clobes Meriwether & Sprengel LLP.
